Definitions

"General Terms and Conditions" means the provisions contained in this document.

"The love doctor events" means the sole proprietorship Lemon Creative Studio, trading under the name The love doctor events, located in Eindhoven, registered in the trade register of the Chamber of Commerce under file number 92525091.

"Participant" means a natural person who enters into an Agreement with The love doctor events.

"Services" means organizing events, trips and other activities for singles by The love doctor events, all in the broadest sense of the word.

"Agreement" means the agreement concluded between The love doctor events and a Participant that extends to the purchase of the Services, in whatever form.

"Request" means a request from a natural person for Services, which may include, but is not limited to, the purchase of a ticket for an event, trip or other activity organized by The love doctor events.

Article 1 – Applicability

1. These General Terms and Conditions apply to all legal relationships between The love doctor events and Participants, including in any case any Agreement for Services.
2. Deviations from these General Terms and Conditions are only valid if The love doctor events and the Participant have expressly agreed in writing.
3. These General Terms and Conditions also apply to additional agreements and subsequent agreements between The love doctor events and the Participant.

Article 2 – Establishment of Agreement

1. All offers and other expressions of The love doctor events are without obligation, unless expressly stated otherwise in writing. The love doctor events has no obligation at any time to accept or fulfill any Request.
2. An Agreement between The love doctor events and a Participant is concluded when The love doctor events approves a Request from the Participant in writing. A registration for an event or trip becomes binding for the Participant at the time of ticket purchase. However, this registration only becomes final when the Participant has received confirmation from The love doctor events for an event, or in the case of a trip, when the travel agreement has been signed.

Article 3 – Services

1. The love doctor events does not guarantee success or a relationship. The love doctor events has an obligation of best efforts and no obligation of results with regard to its services.
2. A ticket or other type of participation certificate for an event or a trip of The love doctor events is personal and cannot be transferred to someone else. Access to an event or trip is only granted upon presentation of a valid ticket.

Article 4 – Participants

1. For participation in events and trips, The love doctor events sets the following requirements for a Participant: single, between 21 and 35 years old and looking for a sustainable and monogamous relationship. If it becomes clear that a Participant does not meet these requirements, the Participant in question may be excluded from all activities offered.
2. The love doctor events may impose additional requirements on Participants who want to participate in events or travel. Consider requirements for minimum or maximum age, education or sexual orientation. These requirements are clearly stated for an event or trip. The purpose of these additional requirements is to define the target group of the activity in question and increase the chance of success, a date or a match.

Article 5 – Obligations of participants

1. Participants are obliged to behave respectfully towards other Participants and the organization of The love doctor events. The use of threatening or offensive language towards Participants or the organization, as well as the use of drugs or excessive alcohol consumption during events or trips of The Love doctor events, is not permitted. The love doctor events is not responsible for the behavior of Participants during events or trips.
2. The Participant is responsible for the timely and complete provision of all information that The love doctor events considers necessary, or that the Participant can expect to be necessary, for the performance of the Services. If this information is not provided to The love doctor events in time, this may result in The love doctor events excluding the Participant from participation in an event or trip. In that case, The love doctor events will charge you for all costs involved.
3. Participants are responsible for their own health and self-reliance. It is up to them to share information about their physical and mental health, including the use of alcohol, drugs or medication, if this could affect the safety or well-being of themselves, other participants or the organization. However, The love doctor events bears no responsibility for the health of Participants during events or travel.
4. Participants on a trip must be in possession of all necessary documents, such as a valid ID, upon departure and during the trip. Participants are responsible for obtaining additional information from the relevant authorities regarding passports, visa requirements and health formalities.

Article 6 – Exclusion from participation

1. The love doctor events reserves the right to exclude a Participant from participation in an event or trip without giving any reason. The Participant will be informed about this and any (down) payments will be refunded (if already paid). If a Participant causes nuisance or damage to other participants, to the organization of The love doctor events or to the location during an activity or trip, he or she may be excluded from further participation with immediate effect. This also applies if incorrect information is provided when booking. Drug use and/or excessive alcohol use also result in exclusion. No refund will be made in the event of exclusion during an event or trip. Additional costs due to exclusion or misconduct can be recovered from the Participant.

Article 7 – Price and payment

1. The prices and discounts used by The love doctor events are the prices and discounts that are valid on the date on which the Agreement is concluded, unless another agreement has been made in writing between The love doctor events and the Participant.
2. The organizer reserves the right to increase the travel price by a maximum of 8% up to 20 days before the start date of a trip. This increase can only take place if it is the result of increases in transport costs, fuel prices, taxes or changes in exchange rates.
3. Payment for a ticket for an event must be made immediately when purchasing the ticket.
4. Payment of the travel sum must be made prior to signing the travel agreement.
5. When The love doctor events sends an invoice to the Participant under the Agreement, it must be paid within 14 days of the invoice date, or earlier if The love doctor events indicates this. Payment must be made according to the method specified by The love doctor events, without right to discount or settlement.
6. All costs associated with (the execution of) the payment, including any provision of security, will be borne by the Participant.
7. As soon as the period referred to in Articles 7.7, 7.4 or 7.5 has expired, the Participant will automatically be in default without notice of default being required. At that time, The love doctor events has the right to discontinue its Services.
8. If the Participant fails to pay the amounts due, The love doctor events has the right to outsource the claim. In that case, the Participant is also obliged to cover the costs of both extrajudicial and judicial procedures. This includes all costs incurred by external experts in addition to the legally established costs related to debt collection or other legal actions. The extrajudicial collection costs incurred by The love doctor events in the event of late payment by the Participant are as follows:
9. 15% of the amount due on the first € 2,500 of the claim;
10. 10% on the next € 2,500 of the claim; and
11. 5% on the next €5,000 of the claim; and
12. 1% on the excess of the claim with a maximum of € 6,775.

The costs for extrajudicial collection are always at least €40.

Article 8 – Liability and indemnification

1. Participation in events and trips is entirely at the Participant's own risk. Participants cannot hold The Love Doctor Events nor the organizers/supervisors liable for damage and/or injuries incurred during events or trips.
2. The love doctor events is only liable for damage suffered by a Participant that is the result of a shortcoming attributable to The love doctor events. The maximum liability of The love doctor events for an attributable shortcoming in the fulfillment of the Agreement is limited to compensation for direct damage, up to a maximum of the invoice amount for the Services provided, or the amount covered by the insurance of The love doctor events for the specific case is paid out. Liability of The love doctor events for indirect damage, including consequential damage and immaterial damage, is excluded.
3. If The love doctor events directly or indirectly engages subordinates, non-subordinates, assistants, third parties and/or other persons in the performance of the Services, any liability of The love doctor events is pursuant to Article 6:76 of the Dutch Civil Code, Article 6: 170 BW, Article 6:171 BW and Article 6:172 BW are excluded and The love doctor events is not liable for damage caused by these persons.
4. The Participant will indemnify The love doctor events against all claims from third parties regarding damage for which the Participant is liable to those third parties under the law. The Participant will compensate The love doctor events for any damage, including all legal costs incurred by The love doctor events, which may be the result of any claim from those third parties.

Article 9 – Mandatory travel insurance

1. Participants in our trips are required to take out appropriate travel insurance and liability insurance before departure. The love doctor events urgently advises to also include medical costs abroad in your travel insurance. The love doctor events also recommends taking out good cancellation insurance. In the event of cancellation, the costs will not be (fully) reimbursed by The love doctor events.

Article 10 – Changes and cancellation of event/trip by The love doctor

1. If The love doctor events is forced to postpone or change an event (including activities, date, time and place) before it starts, The love doctor events will inform the Participant of this by e-mail as soon as possible. If an event is moved and you cannot participate, the participation fee paid will be refunded.
2. The love doctor events reserves the right to cancel an event or trip in exceptional cases, for example when too small a group has registered. The Participants involved will then receive a full refund. Any additional costs incurred by the Participant as a result of this cancellation will not be reimbursed by The love doctor events.
3. Participants receive a draft program prior to a trip. The love doctor events reserves the right to change the draft program. Changes do not constitute grounds for dissolution of the Agreement.

Article 11 – Cancellation of event or trip by Participant

1. If you decide to cancel after paying for an event ticket, you will no longer be entitled to a refund.
2. If you are forced to cancel your trip, you must do so only by email to info@thelovedoctorevents.com. Please note that when canceling a trip, depending on the time of cancellation, certain fees may be charged. You can cancel the travel agreement free of charge within 48 hours. The percentages agreed below (fixed damage) apply, which are based on the time of cancellation, any expected cost savings and income that The love doctor events obtains by selling the canceled trip:
3. in case of cancellation up to the 56th calendar day (exclusive) before the day of departure: 25% of the travel sum;
4. in case of cancellation from the 56th calendar day (inclusive) to the 28th calendar day (exclusive) before the day of departure: 35% of the travel sum;
5. in case of cancellation from the 35th calendar day (inclusive) to the 21st calendar day (exclusive) before the day of departure: 45% of the travel sum;
6. in case of cancellation from the 21st calendar day (inclusive) to the 14th calendar day (exclusive) before the day of departure: 60% of the travel sum;
7. in case of cancellation from the 14th calendar day (inclusive) to the 5th calendar day (exclusive) before the day of departure: 80% of the travel sum;
8. in case of cancellation from the 5th calendar day (inclusive) until the day of departure: 100% of the travel sum.

You will receive confirmation of your cancellation by email within 2 working days. Your trip is only officially canceled when you receive this confirmation from us.

Article 12 – Accommodation when traveling

1. Travel participants must treat the accommodation with respect and leave their room in a tidy condition. If the accommodation is left excessively dirty or causes damage to a Participant, The love doctor events will recover the associated costs from the Participant in question.
2. During our trips it may happen that the accommodations and/or rooms are not entirely identical. There may be differences between the rooms in location, size, furnishings, available furniture, the possibility of a balcony, and the view. The love doctor events does not apply any surcharges or discounts based on these differences in comfort, unless this is specifically stated in the travel agreement. The only time we will apply a rate differential is when privacy differs between room types, such as shared versus private bathroom rooms or single versus shared rooms. For all other slight differences in comfort, you automatically agree to this by participating in the trip.

Article 13 – Visual material

1. Photos and other images may be taken during our trips and events. This material can be used for promotional purposes, such as on our website and social media channels. Participants who do not wish to appear recognizable in the picture are requested to let us know. If desired, we will remove the images on which the Participant in question is clearly recognizable.

Article 14 – Protection of personal data

1. The processing of personal data by The love doctor events takes place in accordance with the privacy statement of The love doctor events and relevant privacy legislation, including the General Data Protection Regulation (GDPR) and the associated GDPR Implementation Act (UAVG). The love doctor events may exchange personal data with external parties that are deployed to support its Services. Personal data is only shared if this is necessary for the aforementioned activities and in line with applicable privacy legislation.
2. The love doctor events will destroy the personal data of the Participant no later than two years after the end of the Agreement.

Article 15 – Intellectual property rights

1. All intellectual property rights relating to the Services provided by The love doctor events belong to The love doctor events.

Article 16 – Applicable law and choice of forum

1. The legal relationships between The love doctor events and a Participant are exclusively governed by Dutch law.
2. Disputes between The love doctor events and the Participant will be settled exclusively by the competent court in the district of East Brabant.
